Terms of Service
Stay App and Light Within Collective Website
Effective date: 19 March 2026
These Terms of Service govern your use of the Stay app and the Light Within Collective website at lightwithincollective.co.za, both operated by Light Within Collective. By using either, you agree to these terms. If you do not agree, please do not use them.
1. About Stay
Stay is a mental wellness companion app designed to support people through difficult moments. It is not a medical device, a clinical service, or a substitute for professional mental health care. Nothing in Stay constitutes medical advice, diagnosis, or treatment.
If you are in crisis or need urgent mental health support, please contact a qualified professional or a crisis service in your country.
2. Eligibility
You must be at least 13 years old to use Stay. By using the app, you confirm that you meet this requirement. If you are under 18, you should have the consent of a parent or guardian.
3. Your account and data
Stay does not currently require you to create an account. Your data is stored locally on your device. You are responsible for maintaining access to your device and for any data you create within the app.
Light Within Collective is not responsible for data lost as a result of device loss, damage, or deletion of the app.
4. Acceptable use
You agree to use Stay and the Light Within Collective website only for lawful purposes and in a way that does not infringe the rights of others. You must not:
- Attempt to reverse engineer, copy, or redistribute the app or its content
- Use the app in any way that could harm, exploit, or deceive other users or third parties
- Attempt to gain unauthorised access to any part of the service or its infrastructure
- Use the AI companion feature to generate harmful, abusive, or illegal content
5. Intellectual property
All content within Stay — including the app design, copy, daily cards, guided audio scripts, and all other written material — is the intellectual property of Light Within Collective. You may not reproduce, distribute, or use this content without written permission.
The Light Within Collective name, logo, and brand assets are protected. Nothing in these terms grants you any right to use them.
6. AI companion
The Talk to Stay feature uses artificial intelligence to generate responses. These responses are not provided by a human, are not clinically reviewed, and should not be relied upon as professional advice of any kind.
Conversations with the AI companion are processed via Anthropic's API. By using Talk to Stay, you acknowledge that your conversation content is transmitted to Anthropic for the purpose of generating a response, in accordance with Anthropic's terms of service and privacy policy.
Light Within Collective is not responsible for the content of AI-generated responses.
7. Subscription and payment
Stay offers a free tier and a paid subscription tier called When I Have Space. The free tier is available indefinitely and will always remain free.
The paid tier is available on a free trial basis for new users. At the end of the trial period, continued access to paid features requires a subscription. Full pricing, billing frequency, accepted payment methods, and cancellation terms will be clearly presented to you before any payment is required.
You will never be charged without being informed of the cost and given the opportunity to confirm. Light Within Collective does not store your payment details.
Refunds are handled in accordance with the relevant app store or payment provider policies in place at the time of purchase.
8. Availability
We aim to keep Stay available at all times but cannot guarantee uninterrupted access. We may need to suspend or restrict access for maintenance, security, or other operational reasons. We will endeavour to give notice where possible.
Light Within Collective reserves the right to discontinue Stay or any of its features at any time, with reasonable notice where possible.
9. Limitation of liability
To the fullest extent permitted by law, Light Within Collective is not liable for any indirect, incidental, or consequential loss or damage arising from your use of Stay or the Light Within Collective website, including but not limited to loss of data, emotional distress, or reliance on app content.
Our total liability to you for any claim arising from your use of Stay shall not exceed the amount you paid for the service in the three months preceding the claim.
10. Mental health disclaimer
Stay is a supportive tool, not a clinical service. It is not designed to diagnose, treat, cure, or prevent any mental health condition. The content of the app — including daily cards, written copy, the AI companion, and all other features — is intended for general wellbeing support only.
If you are experiencing a mental health crisis, please seek professional help immediately. Crisis resources are available within the app.
11. Governing law
These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or your use of Stay will be subject to the jurisdiction of the South African courts.
If you are located in the European Economic Area, you may also have rights under applicable EU consumer protection laws.
12. Changes to these terms
We may update these Terms of Service from time to time. When we do, we will update the effective date at the top of this document. Continued use of Stay or the Light Within Collective website after any changes constitutes acceptance of the updated terms.
